May 2, 2006 Nashville, TN. The Tennessee Attorney General has filed charges against eBay/Amazon/Yahoo Seller Consumer Depot L.L.C. and Martin "Marty" Randolph Filke. The following Public Documents are available: Marty Fike, an eBay seller, has been charged with violations of the Tennessee Consumer Protection Act of 1977 by the Tennessee Attorney General. July 31, 2006 The parties were asked to return to court last week. The court still did not have a decision and kept the case under advisement, but gave the plaintiff some preliminary information which seemed to agree with the State's position that deception was being committed by the defendants. The parties are to report back to court on August 25, 2006 July 11, 2006 The day before the original June 30 hearing the TN AG received a call from the court advising the hearing would have to be postponed due to a scheduling conflict on the court's calendar. It was rescheduled to last Tuesday, July 11, and the case was presented that day. It quickly became obvious the case was not a typical temporary injunction case, but was definitely much larger and more complex. The court did not issue a decision that day. The court took the case under advisement, so everyone is waiting on the court's decision. It is expected in a few weeks at least.
